Yes — when you choose arbitration, the final award is binding and enforceable under the Federal Arbitration Act and (for international cases) the New York Convention. For mediation, settlements become binding once both parties sign the final agreement, which is drafted by our staff attorneys.

If you have a contract with an arbitration clause, the matter proceeds and an award can be issued without their participation. For voluntary mediation, our case officers will outreach to the other party — about 78% accept the invitation. If they decline, we refund all but the case-review fee.
Yes. All sessions, documents, and communications are protected by strict confidentiality agreements and federal evidentiary privileges. Nothing said in mediation can be used in later proceedings if the matter doesn't settle.
